Ad valorem tax sales can be lucrative but also frustrating for investors and debilitating for homeowners. In September 2021, pursuant to Ala. Code Section 40-10-180, the Bessemer and Birmingham Divisions of Jefferson County, Alabama each issued a notice of declaration to conduct a tax lien sale in 2022, rather than a traditional tax sale. Following dozens of other counties in Alabama electing to take advantage of Act 2018-577, which provides counties an alternative remedy for collecting delinquent property taxes. Jefferson County will now abandon the familiar, but often misunderstood and abused tax sale process. This shift presents an opportunity for your investor clients and your practice, while affording more fairness to homeowners unable to pay their taxes.
