On April 14, 2022, Alabama Governor Kay Ivey signed into law Act 2022-427, the provisions of which will be codified at ALA. CODE §§ 43-8-210 through 43-8-217. The Act, which takes effect on January 1, 2023, significantly changes the governing probate law in Alabama regarding: (i) the proper jurisdiction for the filing of a will contest; (ii) the removal of estate administrations and will contests from probate court to circuit court; and (iii) the remand of estate administrations and will contests from circuit court to probate court. In this CLE, guest speakers Vincent J. Schilleci III and Megan M. Kelly, will discuss the substantive provisions of, and changes to this area of the law under, new ALA CODE §§ 43-8-210 through 43-8-217.
